Farmer killed over fish soup

HC gave attacker bail, saying the assault was not premeditated

A farmer lost his life after being hit on his private parts by a friend. His strange death has been classified as due to “vasovagal shock as a result of blunt injury to the testes.” The assault took place because he denied fish soup to the friend! Now, the HC has released the friend on bail stating there was no premeditation to kill in this incident.
Hanumantha Bajari, 30, a peasant from Mirajpur, Raichur, approached the HC seeking bail. He had spent three-and-a-half months in jail for killing his friend Kariyappa. His story was that he was a close friend of Kariyappa. On October 1, 2014, he smelt fish being eaten in Kariyappa’s house. At around 8 pm, he went to their home and found Kariyappa and wife sitting outside.
Hanumantha asked for fish soup but Kariyappa’s wife told him they had finished dinner and there was nothing left.

Hanumantha was enraged and started abusing her. Kariyappa intervened but Hanumantha assaulted him on his private parts with his knee. Kariyappa sustained internal injuries and died on the way to hospital. The doctors declared him brought dead and blamed it on vasovagal shock. A case was registered at Idapnoor police station.
Hanumantha was sent to judicial custody soon after. In the HC, the petition for bail came up before Justice KN Phaneendra, whose order said there was no previous ill-will between Hanumantha and Kariyappa. However, condemning the assault, it said the court can use discretion to enlarge the petitioner on bail as he had already been jailed.
