Café Madras, the iconic Matunga eatery established in the 1950s, got a reprieve from the Bombay high court on Wednesday.

The court ruled that a Jalgaon-based eatery, owned by Lime and Chilli Hospitality Services, had infringed on the ‘Cafe Madras’ trademark by using the same name.

Cafe Madras had alleged ‘infringement and passing off’ in its suit. Justice Gautam S Patel held that the use of an identical trademark was not bona fide.

Café Madras had filed the  suit in 2012 through Bhagwati & Co, Advocates & Attorneys after the Jalgaon-based company refused to desist from using the registered trade mark despite being served a legal notice.
