The Madras High Court on Wednesday ordered notice on an application filed by a financier seeking to implead himself as a party in a suit filed by actor Rajinikanth. The actor had filed the case against using his name in the forthcoming film “Main Hoon Rajinikanth,” produced in Mumbai.
Justice R.Subbiah said that the counter should be filed in a week. In September last year, the High Court had restrained Varsha Productions from using the name/image/caricature/style of delivering dialogues of the actor in “Main Hoon Rajinikanth.”
In the application, the financier, Mukandchand Bothra, alleged that Kasthuriraja, father of actor Dhanush, who is the son-in-law of Mr.Rajinikanth, had obtained Rs.65 lakh from him. He had promised that even if he failed to repay the sum, the actor would discharge the amount. Mr.Bothra said that when he presented the cheques for encashment, they were returned. Mr.Kasthuriraja did not keep his promise. Mr.Rajinikanth also did not take any action against him.
The applicant said that he came to know that Mr.Rajinikanth had filed a suit against a Mumbai company for misusing his name. He said that before getting an order of injunction in that case, Mr.Rajinikanth should have obtained an injunction against Mr.Kasthuriraja for misusing his name.
