Home Minister Ramesh Chennithala has said that the proceedings for slapping provisions of the Kerala Anti-Social Activities (Prevention) Act (KAAPA) on controversial businessman Mohamed Nisham, accused of murder of security guard Chandrabose, are on and that the Act will be invoked once Nisham gets bail.
Replying to questions at a news conference here on Thursday, Mr. Chennithala said the Act could not be invoked when the accused was in judicial custody.
“The Act is meant for preventive arrest and custody for up to one year.
“How can KAAPA be slapped on a person who is already in judicial custody,” the Minister for Home. Chennithala asked, and urged the media not to jump to conclusions heeding the views of interested persons.
Mr. Chennithala said the police could not be blamed for not preserving the clothes of the deceased. The hospital authorities should have kept the clothes in safe custody, he said.
