Decide plea on Metro line, SC tells HC

It asked the parties to lead their arguments in the High Court.

The Supreme Court on Monday ordered a status quo with regard to the execution of a Rs 665 crore-project on the Delhi Metro’s Ghaziabad line, and urged the Delhi High Court to expeditiously decide a petition filed by Gammon India Ltd against the award of contract. Gammon has claimed it was denied the contract for the project despite its financial bid being lower than the company which bagged it.

A bench of Justices T S Thakur and Adarsh K Goel disposed of a petition filed by Gammon, after ordering a status quo into the matter. It asked the parties to lead their arguments in the High Court.

Gammon had moved an appeal after the High Court refused to stay the operation of contract awarded to GYT-TPL Joint Venture.

The bench said the parties should argue their cases in the High Court, which will commence the final hearing in the case on February 25.

During arguments, Solicitor General Ranjit Kumar justified the decision not to award the contract to Gammon, as the structures built by the company had collapsed in Zamrudpur (Delhi) and in Noida (UP). The counsel for Gammon, however, said the contract was not rejected on this ground.

Senior advocate Kapil Sibal, appearing for GYT-TPL Joint Venture, told the bench that the company has already started work on the project, and hence, a status quo order ought not to be issued.

Sibal said the project will become subject to the final outcome of the petition. The bench, however, said it did not want prejudice to be caused to any party because of the uncertainty, and hence, work on the project should stop till the dispute is resolved.
