CHANDIGARH: The Haryana Urban Development Authority (HUDA) would issue notices to Panchkula schools upgraded and recognized by the education department in violation of terms and conditions of allotment of land, HUDA told the Punjab and Haryana high court on Wednesday.
During the hearing of a petition filed by Vijay Pal Singh and 28 other residents of Sector 7, Panchkula, HUDA said the decision was taken after its survey revealed a large number of schools were violating the conditions under which they were given land.
The authority has also decided to issue notices to stop the misuse and initiate resumption proceedings in case no measures were taken.
The petitioners have alleged Tulip School run by Ajay Memorial Education Society, Panchkula, was granted permanent recognition for classes I to V under the board of secondary education with effect from April 1, 2012, although HUDA had allotted the site to the society only for a "nursery school". They had stated that a nursery school run in a park, surrounded by residential houses, was creating traffic, noise and environmental pollution, and was disturbing for the locality in view of increase in number of students and vehicles entering streets opposite their houses.
It was also informed that many other schools were operating in Panchkula in violation of terms and conditions of allotment of site. Many such schools were allotted land for opening a nursery or primary school, but the education department upgraded them to primary, high or higher secondary schools, the petitioners alleged.
The HC had ordered HUDA to look into the matter and take a decision in accordance with law. The HUDA then conducted its survey. The case would come up for hearing on February 11.
