TS orders to take over Bhoodan Board set aside

Justice Challa Kodanda Ram of Hydera-bad High Court on Thursday suspended the GO issued by the State government superseding the Bhoodan Board. It was directed that the records be returned to the board.

These interim orders were in writ petitions filed by Bhoodan Board. They contended that the GO issued by the Telangana State government in July 2014 was contrary to the Bhoodan Board Act. The term of the board is till 2016 and the government couldn’t have asked the secretary of the govern-ment to take over the functioning of the board.

The Telangana State government contended that after the bifurcation, the State government had the power to supersede the Board. Justice Kodanda Ram felt that the issue needed deeper examina-tion as the interpretation of the powers of each State government after the bifurcation of State vis-à-vis the Bhoodan Board Act are to be adjudicated. He referred the main issue to the division Bench.

Regarding the interim orders, the judge agreed with the Telangana State government that section nine of the Bhoodan Board Act empowers the State government to appoint a new board and supersede the present board. The judge made it clear that the circumstances mentioned in section nine like non-functioning and malfunctioning of the board do not exist now.Police directed to file affidavit

A division Bench of Hyderabad High Court comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar on Thursday directed the State police to file an affid-avit regarding an allegation that Dubashi Bharathi, wife of senior Maoist leader, was under illegal custody of the police.

These orders were passed in a Habeas corpus petition seeking the production of the wife of Maoist leader Dubashi Shanker, before the court. This case was filed by Varavara Rao, the revolutionary writer.

He alleged that the SIB police had picked up Bharathi illegally on the evening of January 20 for want of information regarding the whereabouts of her husband. He requested the court to direct the police to produce her before the court.
