‘Money laundering’ case: No regular annual returns by 12 companies under ED scanner

Companies Act, mandates every company to e-file its balance sheet, along with details of directors

Except two, none of the other 12 companies which are under the Enforcement Directorate scanner in the alleged money laundering case against city-based advocate Mukesh Mittal has filed regular annual returns to the Registrar of Companies in violation of the Companies Act, 1956, it is learnt.

The Companies Act, which is the guiding law for companies, mandates every company to e-file its balance sheet and profit and loss account, along with details of all directors and shareholders, as part of its annual return every year.

Records accessed by Newsline show that two companies, namely Adarsh Urban Infra Pvt Ltd and Adarsh Parsonage Heritage Jungle Club Pvt Ltd, have not filed their annual return since their inception. Both are registered at different residential addresses in Sector 40.

While Adarsh Urban Infra was registered in 2012 with Barinder Singh and Akshay Mittal as directors, Adarsh Parsonage was registered in 2010 with three directors, namely Barinder Singh, Vijay Pal Singh and Vikas Sood. In May 2011, Prabhjot Singh replaced Vikas Sood as director.

While Akshay is Mukesh Mittal’s son, both Barinder and Prabhjot are the sons of Vijay Pal Singh aka Dimpy, a former Chandigarh Youth Congress president who was recently held for cheating S S Virk, former DGP of Punjab and Maharashtra.

The ED has not yet summoned Dimpy or his family members, but they might come under probe due to their involvement in a number of other companies as directors, ED officials said.

Another company Adarsh Hospitality and Resorts Ltd, which came up in 2008 with Dimpy and son Barinder as directors, has not filed a return after 2011. Chandigarh Stores Pvt Ltd did not file any return after 2007. Registered in 1999 at a residential address in Manimajra, one of its directors Rajiv Awasthi was recently summoned by the ED for questioning. Sources said that another director Santosh Awasthi is a suspect in the ongoing investigation.

Further, two companies, namely Awasthi Real Estate Pvt Ltd and Mount Hills Services and Promoters Pvt Ltd, have not filed their annual returns after 2012. Mukesh Mittal’s two clerks, Ajay Singh and Parveen Kumar, were initial directors of Mount Hills Services and Promoters Pvt Ltd, when it was registered in 2008 at a commercial address in Sector 8. Parveen Kumar was replaced with Mittal’s driver Lal Chand in October 2008 and later in March 2011, another person Rakesh Wadhawan was inducted as director.

Even in Awasthi Real Estate company, Ajay Singh is a director along with Rajiv Awasthi.

Lal Chand, Parveen Kumar and Ajay Singh are already under the ED scanner and they might be arrested if their anticipatory bail is rejected by court on Friday.

There are no records of the annual returns of as many as five companies after 2013. These are Sarvilla Builders and Developers Pvt Ltd, Solan SR Services Pvt Ltd, Sharvila Hotels and Resorts Pvt Ltd, Sharvila Foundations Pvt Ltd and Shivalik Services.

In most of these companies, Mittal’s clerks and drivers are directors, except Solan SR Services, which has Zora Singh as additional director along with his wife Tejinder Kaur and son Sandeep Singh. Earlier Mittal was director in this company along with his wife Alka Mittal and his clerks Ajay Singh and Parveen Kumar.

Zora Singh, chancellor of Desh Bhagat Group of colleges, said he had purchased this company from Mukesh Mittal in 2013 with a Rs 6-crore debt.

RMC Printers filed its last return in 2010. Its directors are Mukesh Mittal and Alka Mittal.

The only two companies which have filed returns until 2014 are Lake View Services and Promoters Pvt Ltd and Quality Impex Pvt Ltd.
