Curb exploitation of children in ashram shalas, High Court tells state

Justices A S Oka and A S Gadkari were hearing a PIL filed by Help Mumbai Foundation in which the petitioner had raised the issue of exploitation of children residing in ashram shalas.

Observing that it was the obligation of the state government for upholding the rights of children, the Bombay High Court Wednesday directed the state to take appropriate action to stop exploitation of children living in hostels known as Warkari Vidyarthi Vastigruh.

Justices A S Oka and A S Gadkari were hearing a PIL filed by Help Mumbai Foundation under which the petitioner had raised the issue of exploitation of children residing in ashram shalas. In the last hearing, the HC had sought reply from the government in this regard.

There are 109 hostels or ashram shalas in Pune. The state government had carried out a survey of these hostels. Of these, only 34 were registered with the government while the others were not. “We have seen all the reports in relation to each of these hostels. The reports show that some of the children were exploited and elementary facilities were lacking,” observed Justices A S Oka and A S Gadkari.

The report was submitted in July but action was taken after a long time after the issue was taken up by court. “Some reports show that children were exploited. It is the obligation of the state to take action and hold up the rights of children. We direct them to take appropriate action to stop exploitation of children. The action taken report will have to be submitted by January 16, 2013,” said the court. The next date of hearing in this matter is January 23, 2015.

The court has also asked the Maharashtra government to inform them when it will implement all the recommendations of Justice (retd) CS Dharmadhikari committee, to curb atrocities against women.
