MUMBAI: The postponement of the already-delayed Annual General Meeting (AGM) from December 26 to January 3 due to its president Sharad Pawar's ill health has caused a bit of unrest amongst a few members of the Mumbai Cricket Association (MCA), who have questioned the legality of the move.
"As per its own constitution, the MCA should have held the AGM before September. Being a charitable institution, which comes under the Society act, it has to hold the AGM once a year.
In this case, the previous AGM took place in October last year," an MCA member told TOI on Monday. Citing the law, he said that a meeting could not be postponed once a notice about it is sent to the members. It has to be held, and then, if the need be, adjourned 'sine die' (indefinitely) or to a later date. "In this case, the MCA had earlier sent out a notice to us informing about the AGM on December 26, along with the annual accounts, before postponing it," said a member.
A top MCA official, however, claimed that there was a provision in the constitution to postpone the AGM if the president was unwell. "Pawar is disturbed by the Mumbai Ranji team's poor results so far this season. He wants to chair the meeting so that some big decisions can be taken if things don't improve. He wants to meet the team too," he said.
Defending the postponement of the AGM further, he said: "Some of the members themselves requested Pawar to attend the meeting, since it is the only during the AGM that they can get to meet him and convey their issues. After he expressed his interest in coming for the meeting, we asked him to give a written request in this regard, which he did. The managing committee than approved his request for a meeting on January 23," he said.
