A 20 year-old 'Dalit' girl was allegedly raped and murdered in Haryana's Jind city in August last year. The girl's father Surat Singh was not happy with the way Haryana police had started the investigation. Even locals had staged protests against the erstwhile Congress government led by Bhupinder Singh Hooda and in October last year, and the police had filed a closure report, saying it is a case of suicide as the girl had consumed sulphas due to some personal problems.
Being aggrieved with the police's theory, Singh has alleged that cops are shielding some important persons and approached the supreme court for a transfer of the probe to the CBI. Now, the premier investigating agency has said that "this case does not fulfil the criteria" laid down by the apex court in its previous judgment to allow a CBI investigation.
Filing an affidavit recently, in response to the notice issued by the top court on Singh's petition, the CBI said " The case does not fall within the guidelines laid down by the Supreme court in the case of "state of West Bengal vs Committee for Protection of Democratic rights…"
"The Haryana police having trained investigating officers who are well equipped to investigate such cases. Haryana police with its vast resources at its command can conduct an investigation of the case properly under the supervision of senior officers of the known reputation and experience," said the affidavit.
In his plea, Singh said his youngest daughter had left home in Baniya Khera Gaon on August 24, going to Jind to give her Junior Board Teacher (JBT) exam. It was her final exam.
The JBT exam was scheduled from 2 pm to 5 pm. At 4 pm he got a call from an unknown man, saying he had found some papers with his number on them. On search, the body was found from bushes near a canal.
Subsequently, two police stations kept Singh waiting as they fought over the jurisdiction of the case. The FIR was finally registered at a city police station on the charges of rape and murder but they did not lodge the case under the SC/ST Act.
Angry villagers led by some leaders from the Bahujan Samaj Party (BSP) had blocked traffic to protest against the Hooda government which resulted in a police lathicharge. Police even arrested some villagers.
The CBI affidavit referred to the two post-mortems conducted at Jind Hospital and Rohtak's PGIMS. The third post-mortem was conducted by AIIMS in New Delhi. All reports had ruled out rape and murder.
