Lawyer booked for FB post still at large, complainant meets top cop

An FIR was registered against lawyer Vijay Gaikwad for a Facebook post that allegedly had objectionable remarks.

Angry that there was no arrest despite having registered an FIR on December 12 against a lawyer for an alleged Facebook post that had objectionable remarks that could hurt the sentiments of the Muslim community, the complainant Moin Khan along with his advocate Yusuf Khan met Joint Commissioner of Police (law and order) Dhananjay Kamalakar on Tuesday.

The complainant said, “On December 15, we were told by the deputy commissioner of police, Ashok Dudhe that the lawyer Vijay Gaikwad will be arrested within 24 hours. The process of arrest requires permission by the Inspector General level officer, and we were told that it was being processed. However, no progress has been made in the case so far.”

Vijay Gaikwad was booked under various Indian Penal Code sections like 295 (A) (Deliberate and malicious acts), 153 (A) (Promoting enmity between different groups on grounds of religion), 504 (Intentional insult with intent to provoke breach of the peace) and 500 (Punishment for defamation) along with Information and Technology Act, 2000 sections 66(A) and 67.

“Under the IT Act of 2000, permission is required for an arrest under Section 66 (A), but there are other sections also under Indian Penal Code like 295(A), 153 (A) and 504, under these sections the arrest should be made immediate,” said Raj Awasthi , advocate. “The matter is under investigation at present. I can say only this,” said Ashok Dudhe,deputy commissioner of police (zone-4).
