Mumbai Warriors defend their football identity

Mumbai Warriors, a city-based football club, has defended its right against the use of its name by Multi Screen Media (MSM), Marinating Films Private Limited and two individuals in the forthcoming sports reality show ‘Box Cricket League.’

The show, to be telecasted on Sony TV, has eight teams representing different city franchisees playing in an air-condition studio. The city-based team was named Mumbai Warriors and the football club had last week moved the Bombay High Court to stop the parties from using its brand name.

The parties opted for an out-of-court settlement with MSM agreeing to not promote the trademark ‘Mumbai Warriors’ and to change the team name from next season.

Mumbai Warriors legal advisor Jitendra Singh said they came to know about the event and the Mumbai franchise through internet as the Mumbai Warriors were promoted widely and this would have been detrimental to their brand.

“Our only aim was to protect the club’s identity and brand name and hence we readily accepted the compromise formula as it was in the interest of both parties,” said Singh, who moved the Court through their advocates Tanmaye Gadre, Vishal Kanade and Shailendra Singh.

According to the consent terms - a copy of which is with Mirror -- signed by Mumbai Warriors Soccer Club Pvt Ltd. and MSM, “the Defendants undertake to show a disclaimer for a minimum period of 3-5 seconds as per standard disclaimers of the Channel at the beginning or at the end of every episode as referred in Clause 2, stating that the team “Mumbai Warriors” is in no manner related to the Plantiff Company Mumbai Warriors Soccer Club Pvt. Ltd.”

MSM or Marinating Films could not be reached for a comment.
