Former Chief Minister B S Yeddyurappa has just recovered from a bout of amnesia. With CID sleuths inching close to cracking the case, the former CM did a complete turnaround and owned up to making the notation recommending de-notification of land worth around Rs 100 crore.
A year ago, Yeddyurappa had filed a complaint asking the government to order an inquiry into what he had claimed were mysterious lines on a file purportedly signed by him. He sought the probe following a legal notice asking him reasons for de-notifying the land, measuring 11.5 acres, near Electronic City. The current government had ordered a CID probe into the case.
Bangalore Mirror had carried a front page report ‘Yeddyurappa, the whistleblower, sets off CID probe’ (October 21, 2014) on the alleged whodunit. However, a few weeks ago, with CID investigations moving at a face pace and the people, who had been in his secretariat, faced with the prospect of being grilled, the MP quickly spilled out his admission.
The dramatic turn of events comes just a year after Yeddyurappa expressed shock over the legal notice and feigned total ignorance about the insertion of two lines in the government order signed by him when he held the State’s reins. He had even sought cancellation of that de-notification order and action against the miscreants who had played dirty. By making a written submission to CID sleuths now, admitting he signed the de-notification and he was aware of the two lines which were added between his and the Urban Development Secretary’s signatures, Yeddy stands twice guilty. The question now is whether CID will file a counter complaint against the former CM for making a false complaint.
A CID sleuth, who is part of the investigating team, said they were close to solving the case and the probe strongly pointed to someone close to the former CM when Yeddyurappa sent his confession. His letter reportedly states: “By mistake, I have given a complaint about the de-notification of the Rupena Agrahara land. I was completely aware of the process of this particular de-notification and I was aware of the two lines typed before my signature. Everything in this case was done with my knowledge.”

The de-notification story
The prime property, located at Rupena Agrahara on Hosur Road, on the IT corridor near Electronic City, has long been a hot potato with successive governments turning down proposals for de-notification for the past 15 years. CID sources say the S M Krishna government had got this proposal, but turned it down. The Dharam Singh and H D Kumar Swamy governments toed the same line. But there was a twist in the tale in February-March 2010 when the land was suddenly de-notified. The plot worth over Rs 100 crore and measuring 11.5 acres is located in Bangalore South taluk, Begur hobli, Rupena Aghrahara village, under two survey numbers.
Thirty guntas fall under survey no. 30/6B and 11.20 acres under survey no. 31/1. The land was de-notified under Land Acquisition Act 1894; section 28(1) of the government’s notification number UDD/60/MNX/2010. This notification order was out on 07/05/2010.
In his last complaint to the then state chief secretary, Yeddyurappa had claimed he was in the dark about the de-notification case till one M Murugan and his advocate C N Govinda Reddy sent him a legal notice. Stating he had de-notified the land illegally, the notice called upon him to look into this case immediately and acquire the land back from the beneficiary.
“After getting the legal notice, I had to get the relevant documents under Right to Information Act (RTI) since I did not have any details of the case,” the former CM had said. Yeddyurappa had claimed following a thorough scan of the papers, he was shocked to see they had been modified.
BSY was unavailable for comment, despite numerous attempts made by BM.


‘I REMEMBER...‘

“I remember looking at the documents. The file with government notification number UDD/60/ MNX/2010 on 07/05/2010 states de-notification of the said land is not possible under the law.
This has been clearly said in this particular file and in notes 8 to 13,” Yeddyurappa had said. The former CM had said the land belongs to BDA and his noting on the file acknowledges that. “I have clearly approved the ‘not to de-notify the land’ and I have put my signature after getting the file from then Principal Secretary, Urban Development Department, Subir Hari Singh.”

Yeddyurappa had said in his complaint that someone had misused the place between his signature and that of the principal secretary to insert two lines to completely alter the meaning.
“They have used manual typing machine, which cannot be found anywhere now in government offices and they have typed in between the two signatures. It subsequently reads: ‘Note no. 14) It has been ordered to de-notify the Survey no 30:6B; 30 guntas and survey no 31:1; 11.2 acres land’ followed by my signature.

They have forged this document,” Yeddyurappa had contended. The former CM’s admission a few weeks ago has taken CID officials
by surprise. While this brings the curtains down on the case, a few officers are of the opinion that BSY should be charged for filing a false complaint.
