Magistrate prescribes procedure for extradition

Hyderabad: America’s most wanted fugitive, Muddamalle Amit Livingston, 46, who was arrested in Sainikpuri by Cyberabad police and Crime Investigation Department sleuths, in May, is to be extradited to USA. A Delhi court on Tuesday recommended handing him over to US criminal justice officials.

Hyderabad-born Amit Livingston, a naturalised US citizen, was convicted by a Texas court for murdering his girlfriend. Interpol issued a red corner notice for him in 2008, after he escaped to India. Livingston has been on the run for seven years.

The convict, who had fled from US after being sentenced to 23 years in jail, had voluntarily consented that he be sent to the states for serving the sentence.

Additional chief metropolitan magistrate Ajay Garg recommended extradition of Amit Muddamalle Livingston, saying the offence alleged against him was “extraditable” and prescribed procedure was followed as a request from the US has been submitted through the diplomatic channel along with all relevant documents.

“I hereby recommend to the Union of India to extradite the fugitive criminal, Amit Muddamalle Livingston, to the requesting state i.e. United States of America,” the ACMM said.

The court, in its seven-page order, noted that Amit “Has also voluntarily consented to surrender to the requesting state and wants to serve sentence for the offence committed by him.”

Advocate Naveen Kumar Matta, who appeared for the Ministry of External Affairs told the court that Amit was arrested in Hyderabad on May 7, this year after which he was taken to Delhi.

Mr Matta said that a request for arrest and extradition of Amit was received from the US and according to the documents received by the MEA the fugitive criminal was wanted to serve the jail term there which was awarded by the district court of Cameron County in Texas.

The ministry told the court that as per the affidavit of Chief First Assistant District Attorney of the US, on November 18, 2005, Amit was indicted there for intentionally causing the death of Hermilia Garcia Hernandez on September 30, 2005 in Texas.

It said that Amit surrendered before the authorities and on February 13, 2007, he entered a plea of guilty through an agreement which was accepted by the court there and he was sentenced to 23 years in jail.
