CHENNAI: The VII assistant city civil court has granted an interim injunction restraining Aruna Hotels from evicting Kumaran Silks from a rented property in Nungambakkam.
R Venkatesh counsel for P R Babu, managing partner of M/s Kumaran Silks said he had entered into a commercial rent agreement with M Sivaraman, CMD of M/s Aruna Hotels Ltd to rent a property.
The agreement was valid from January 1 to December 19. According to the terms of the agreement, Babu would not pay any rent. Instead, he had to pay a lease amount of 2.35 crore which would be repaid without interest on termination of the agreement, said the counsel.
After Babu paid the security deposit, Sivaraman asked him to vacate the rented premises within four weeks. In October, he disconnected the water supply. On Novemeber 4, Sivaraman sent rowdies to threaten him. As such, he had moved the court seeking injunction to restrain the owner from interfering with possession of the property.
Stating there was a prime facie case, the court granted ad-interim injunction and issued notice to Aruna Hotels. The matter has been posted to November 28 for hearing.
