MUMBAI: In a setback to the National Mineral Development Corporation (NMDC), the Supreme Court on Monday declined to interfere with an interim order passed by the Chhatisgarh high court that prevented any mining lease being granted to the corporation till Essar Steel’s plea in connection with the Bailadila 4 iron ore mine is heard.
The Chhattisgarh HC had on October 29 had passed the interim order against NMDC, a public sector undertaking, while hearing a petition filed by Essar Steel.
The HC had sought replies from the PSU and the state government after Essar Steel challenged an order of a mines tribunal.
The tribunal had rejected Essar Steel’s plea against the denial of mining licence, and the steelmaker then moved the HC. The PSU rushed to the SC saying that the HC order was “unusual” and contrary to the principle that public interest shall prevail over private interest.
A three judge SC bench headed by the Chief Justice, however, said it found no reason to disturb the HC order at this stage and said the contentions can be raised later by the PSU in court. Hemant Kumar, Essar Group general counsel, confirmed the dismissal order of the SC, but declined to further comment on the matter.
