Police unable to identify Union minister Nihal Chand’s address to deliver summons

Since all the accused could not appear for the hearing on Wednesday, the court was adjourned until Dec 6.

The alleged rape of a 20-year-old woman involving Union Minister Nihal Chand Meghwal is stuck in ‘identification of residences’ with the police unable to identify the ‘correct addresses’ of the accused to deliver the court summons. Meghwal and six others out of the total 17 accused in the case appeared through their lawyers before a lower court on Wednesday citing suo moto cognizance of the court hearing through media reports. They told the court that no summons was served on them.

The court was told by the local police that the exact residential addresses of five accused named in the revision petition have not been mentioned by the victim, hence they could not be traced. The Vaishali Nagar police station cited ‘work pressure’ for not being able to look for the prime accused Om Prakash Godara, the alleged victim’s husband. Former MLA Yogeshwar Garg also could not be found at the given rented accommodation while his son Prakash Punj Garg, also named in the case, appeared through a lawyer.

The court in its previous hearing on August 20 had asked Ganganagar Superintendent of Police to find Union Minister Meghwal and ensure that the summons is delivered to him, be it in Ganganagar or New Delhi. As Meghwal’s lawyer, AK Jain, appeared in court, he maintained that the summons was not served on him but he had taken suo moto cognizance of the case hearing and appeared on behalf of Meghwal. The SP did not appear for the hearing or send any representative to explain why the summons could not be delivered.

Since all the accused or their representatives could not appear for the hearing on Wednesday, the court was adjourned for next hearing on December 6.

“As responsible citizens we have taken suo moto cognizance of the court hearing and appeared. The summons was not delivered to Meghwal. It is a fabricated case. In February this year, the magistrate court had dismissed the case as false and baseless. It is a revision petition. The alleged victim should have furnished the residential and other identification details of the accused, which she has been unable to do so far,” AK Jain told the Indian Express.

Chandu Ram Yadav, the victim’s lawyer, said, “It is not the victim’s job to locate the accused. The police should do it. These names were mentioned right from the beginning of the case. The police has done nothing in the case so far. How can the victim be expected to look up each of the accused and where they live currently?”
