Shield people who help accident victims from legal hassles, SC tells govt

The Supreme Court on Wednesday directed the central government to issue an executive order to protect good samaritans who helped injured persons on the road, from legal and procedural hassles in the hands of the police, hospitals and legal entities.

The order was passed by a bench of Justices Ranjan Gogoi and Rohinton F Nariman after it accepted majority of recommendations by a court-appointed panel.

Earlier, the government told the court that it was in favour of setting up a special police force and also a road safety fund to help victims of mishaps on national highway across the country.

The Ministry of Road Transport and Highways (MoRTH) said it has initiated a process to create a lead agency or authority for road safety at the national level and has asked the state governments also to do the same.

It said though the creation of Highway Police Force falls under the domain of state governments but the Ministry of Home Affairs (MHA) should facilitate its creation.
MoRTH in an affidavit gave its response to the recommendations made by the apex court-appointed panel on road safety and agreed to most of the suggestions mooted by the committee.
