From Dongri to CST: Jurisdiction fight over train accident victim

When Vashi resident Mukesh Sonawane, 31, regained consciousness last Wednesday, he found that he had severe head injuries and items worth Rs4,500 stolen along with his mobile phone. To add to his woes, he was clueless about how he reached Sandhurst Road after boarding a Belapur train to reach home. As if that wasn't enough, his family was made to go from Dongri city police station to CST railway station and then Wadala railway police (RP) to file a complaint.

Sonawane boarded a Belapur train at 11:24 am from Masjid Bandar. He was carrying items worth Rs4,500 to sell at his stall in Vashi for Diwali. Also on his person, was a brand new cell phone worth Rs4,500. After boarding the train, he kept the items on the rack above his seat.

About the incident, Sonawane said, “I don't know what happened after I sat down. I regained consciousness around 1:15pm at a compound between Masjid Bandar and Sandhurst road.”

Sonawane then walked till Dongri police station, where officers suggested that he get himself admitted at JJ hospital before filing a complaint. He complied and got operated on his forehead and occipital (skull) region.
The government railway police constable present at the hospital called Wadala RP, who lodged a complaint only on October 24 when Sonawane visited the station with his parents.

Sonawane's sister, Vidya said, “It is not right on the part of police to make us run pillar to post just to file a case. On top of that, they made my brother write that he has no complaint against anyone.”

Sandip Dal, senior inspector (SI), Dongri, said, “Sonawane was in a position to walk, so we requested him to get admitted and advised him to register a case at Wadala RP.”

Pramod Dhawre, SI, Wadala RP said, “Since the incident occurred near the railway boundary that falls under the jurisdiction of Dongri police station, we cannot register a case.”
