HC asks ITBP to produce SI’s record by Nov 26

JAMMU, Oct 25: The State High Court has directed the Indo Tibetan Border Police (ITBP) to make available record of Sudesh Kumar Gargotra Sub Inspector, ITBP by next date of hearing.
While hearing the Service Writ Petition (SPL) of Sudesh Kumar Gargotra, versus Union of India, Director General ITBP and others on October 22, Justice Tashi Rabstan of J&K High Court, Jammu Wing has also fixed the next date of hearing on November 26, 2014.
The Court has issued directives to N A Choudahry advocate for respondent to make available the records on the next date of hearing. The SWP was filed in State High Court by Mr Gargotra against Union of India seeking justice for himself.
In his petition Gargotra has prayed before the High Court that the case be decided on the basis of merit.
The petitioner in his SWP has also prayed that following the path of truth and honesty as per oath and affirmation taken by him in his basic training course has become cause of imposition of punishments,  mental agony, sufferings, various dismissals and compulsory retirement from his service time and again on the basis of false and frivolous charges. These charges were slapped on him by the Government for detecting 30 percent training allowance scam in high altitude Defense Survival Academy of ITBP Mussoorie (Uttrakhand)  on April 14, 1988, the petitioner stated before the High Court.
In the SWP Mr Gargotra also stated that since then he was tortured by the higher authorities as well as the persons who were involved into de-frauding of Government funds to the tune of multi hundred corores of rupees per annum for which they were not entitled to at all as per order of the Government of India, Department of Personnel and Training dated March 31, 1987.
In 1988 Gargotra had reported the misuse of training allowance by senior officers of ITBP to higher authorities. When his complaint reached to Prime Minister the allowance was slashed from 30 percent to 15 percent which annoyed his all officers.
Since then the SI is facing the official apathy and seeing no alternative to seek justice for himself, he has knocked the doors of court of law.
