Lawyer must put up security for costs in his bid to sue FAI

A US lawyer who is suing the Football Association of Ireland and its chief executive John Delaney must put up security for legal costs in case he loses his High Court action, writes Tim Healy.

Jack F McCarthy III, a former owner and chairman of Limerick FC, is suing the FAI and a number of its officers over losses he says he suffered on an investment in the football club. The defendants deny the claims.

Mr Justice Michael White said that if the New Jersey-based attorney wants to proceed with his action, he will have to allow a charge to be placed over a Dublin apartment, which is owned by a company in which Mr McCarthy has a controlling interest.

This would be an alternative to putting up a cash lodgement against the potential legal costs.
