Arvind Kejriwal, 3 others to face trial in defamation case

The suit was filed by former telecom minister Kapil Sibal’s son, Amit Sibal.

Aam Aadmi Party (AAP) leader Arvind Kejriwal and three others were put on trial by a Delhi court on Saturday in connection with a criminal defamation suit filed by former Telecom Minister Kapil Sibal’s son Amit Sibal.

Metropolitan Magistrate Sunil Kumar Sharma framed charges under Section 500 (defamation) of the IPC against Kejriwal, AAP leader Manish Sisodia, senior lawyer and AAP leader Prashant Bhushan and former AAP leader Shazia Ilmi.

The four pleaded not guilty to the offence and claimed trail. The court will now record the evidence in the case and has fixed the matter to January 17 , 2015.

The defamation suit was filed by Amit Sibal, a senior lawyer, for allegations made by the four during a press conference in May last year. The AAP leaders had alleged that Kapil Sibal wanted to revise a tax demand on telecom company Vodafone and that Amit had taken advantage of his father’s position to represent the company in the court.

In April this year, the Supreme Court rejected a plea filed by Kejriwal to stay proceedings in the case. After the trial court summoned them to appear before it, Kejriwal and Bhushan moved the Delhi High Court seeking discharge from the case. In January, the court  refused their request but permitted them to move a similar plea before the trial court.

“We had made certain allegations of corruption against Kapil Sibal. He had no answers to that and filed a defamation suit through his son. Instead, he should have responded directly to the allegations,” Sisodia said.

Speaking to Newsline, Ilmi said, “…I will definitely pursue the case. If anyone feels that they have been defamed, they have the right to legal recourse.”
