The Health and Safety Executive (HSE) has reported to its board on the outcome of the consultation on the changes proposed to the Construction (Design and Management) Regulations 2007 (CDM 2007). Following the report, most of the regulations will remain as they were drafted originally. However, the HSE will clarify the drafting relating to:
- the transitional provisions;
- the replacement of the competence requirements in CDM 2007 with a general framework based on information, instruction, training and supervision; and
- the removal of the exemption from client responsibilities for "domestic clients".
The report recommends also that the new regulations are accompanied by a new Approved Code of Practice (ACoP), rather than general guidance. However, the current ACoP has been criticised as being lengthy and complex and therefore the new ACoP will be shorter than its predecessor.
The regulations are to come into force in April 2015.
