Student death: HC tells CBI to respond to cops’ plea

The court of Justice S Ravindra Bhat and Justice Vipin Sanghi also directed the CBI to file a chart of the roles assigned to each of the appellant-convicts in the chargesheet and the relative findings of the trial court.

“Appeals admitted. Issue notice. Trial court records are called for. List the matter for possible final hearing. Respondent (CBI) shall file a chart of the roles assigned to each appellant-convicts in the charge sheet and relative findings of the trial court,” the court said.

The court also denied the policemen’s plea for interim suspension of sentence, taking the view that since most of them had obtained bail at some point in the trial proceedings, “there appears to be no ground for suspension of sentence”.

The bail pleas field by the convicts will be heard along with the appeals in 12 weeks.

Those who moved the High Court against their conviction and sentencing were then inspector Santosh Jaiswal, sub-inspectors Gopal Dutt Bhatt, Rajesh Bisht, Neeraj Kumar, Nitin Chauhan and Chandra Mohan Singh Rawat — all convicted on charges of murder. Constables Sunil Saini, Mohan Singh Rana, Nagender Rathi, Ajeet Singh, Inder Bhan Singh, Satbir Singh, and Vikas Baluni were convicted of conspiracy to murder.

The policemen in their appeal have stated that Ranbir Singh, a resident of Ghaziabad, had gone to Dehradun with two others to commit dacoity and had also snatched the service revolver of one of the appellants, all of whom were on security duty on July 3, 2009, in view of the visit of then President Pratibha Patil.
