On August 15, 2014, ALJ Dee Lord issued Order No. 11 in Certain Non-Volatile Memory Chips and Products Containing the Same (Inv. No. 337-TA-916).

By way of background, this investigation is based on an April 29, 2014 complaint filed by Spansion LLC alleging violation of Section 337 in the importation into the U.S. and sale of certain non-volatile memory chips and products containing the same that infringe one or more claims of U.S. Patent Nos. 6,246,611; 6,744,666; 6,399,446; and 6,436,766.  See our May 1, 2014 and June 3, 2014 posts for more details on the complaint and the Notice of Investigation, respectively. 

According to Order No. 11, ALJ Lord set the procedural schedule for the investigation and determined, inter alia, that the evidentiary hearing will commence on March 16, 2014; the Initial Determination on alleged violation of Section 337 will be issued on June 2, 2015; and the target date for completing the investigation is October 2, 2015 (which is approximately seventeen months after institution of the investigation).
