Jihadi conspiracy case: HC reserves order on Hyderabad-based cleric Qavi’s bail plea

Qavi was booked under Prevention of Terrorist Act (POTA), repealed in 2004, who was absconding since the FIR was lodged.

The Gujarat High Court on Tuesday reserved its order on the bail petition moved by Hyderbad-based cleric Abdul Qavi, who is lodged in Sabarmati Central Jail. In March this year, he was arrested by Ahmedabad Detection of Crime Branch (DCB) in connection with 2003 “jihadi conspiracy” case.

Qavi was chargesheeted by DCB for “joining hands with other accused during April 2002 to April 2003 to take revenge of the loss occurred to the lives and properties to the Muslim community following the communal riots in Gujarat after the Godhra train carnage.”

Qavi was booked under Prevention of Terrorist Act (POTA), repealed in 2004, who was absconding since the FIR was lodged. Recently, he was chargesheeted by the DCB which claimed that Qavi attended a meeting where the alleged conspiracy to send youngsters to Pakistan for terrorist training was hatched along with another absconding accused Rasool Party and Mufti Sufian Patangiya.

Delhi-based lawyer Mahmood Pracha, who appeared for Qavi, sought bail on the grounds that the investigators have not produced any evidence suggesting his role in the case.

He said that apart from his name mentioned in one of the statements of a witness, there is no further proof of his client’s involvement in the case. He drew parallels with Akshardham attack case saying that all the accused were acquitted by the Supreme Court on the ground that investigation was not properly done.

He said that this case was also investigated by the same set of people including IPS officer G L Singhal, Tarun Barot and D G Vanzara who are accused in Ishrat Jahan and other fake encounter cases.

DCB officials filed a chargesheet against him stating, “As part of the said conspiracy, the accused Maulana Abdul Qavi (Khavi) son of Abdul Gani had attended the meetings with the earlier chargesheeted accused Abdul Samad Md Ibrahim Sunni among others along with Rasool Party.”
