JAMMU, Aug 14: In an interesting case, the State Vigilance Commission (SVC) has detected that a person, who had lodged a complaint before it staking claim over a piece of land at Sheri, Baramulla, had got the land fraudulently mutated in favour of his father.
After verifications, the SVC has directed the IGP Crime to register a case and asked the Finance Commissioner, Revenue to exercise revisional jurisdiction for setting the records straight.
Sources said in a case titled Muhammad Shaban Sheikh son of Ghulam Muhammad Sheikh, a resident of Parimpora, Srinagar versus Baseer Ahmad Khan (then Deputy Commissioner, Baramulla) and others, which was transferred to the SVC by the State Accountability Commission for further proceedings, the complainant had staked claim over a piece of land measuring 18 marlas situated at Sheri Baramulla.
The complainant had contended that his land had been encroached upon by the State Government and a hospital building constructed there. The Commission after obtaining records from DC Baramulla, CMO Baramulla and Collector Land Acquisition, Flood Control Department and after hearing the parties found that the land in question had been acquired by the State Government in the year 1968 through Flood Control Department.
After proper acquisition of the land, the Department had disbursed the compensation to the land owners strictly in accordance with the respective share of their land which had come under acquisition. Enquiry revealed that Flood Control Department, after acquisition of the land, had not taken possession of said land physically and the land remained vacant on spot.
Subsequently, the Government, constructed a dispensary on 16 marlas of land, which had earlier come under acquisition and which the complainant had claimed to be his proprietary land. The enquiry conducted by the Commission further revealed that after about three decades from the date of acquisition of the land by the Government, the Revenue officers then posted in Sheri, Baramulla acting in league with the complainant’s family fraudulently got the said land mutated under Section 4 & 8 of Agrarian Reforms Act in favour of the father of the complainant.
The fraudulent attestation of mutation and subsequent entries in the revenue records in the name of the complainant gave cause of action to the complainant to claim the compensation in respect of the land which he had acquired fraudulently and dishonestly. In this behalf, the complainant has made all attempts but unfortunately he has so far not succeeded.
The Commission accordingly after thorough investigation and detection of fraud having been committed, has directed IGP, Crime Branch to register a case in the matter. In order to ensure that the revenue records are set right, the matter has also been referred to Financial Commissioner, Revenue who being the competent authority can exercise his revisional jurisdiction to set the records straight.
