Competition issues in the regulation of fixed line broadband have been considered by the NBN Panel of Experts in its review of the telecommunications access regime under Part XIC of theCompetition and Consumer Act 2010 (Cth) and the rules about NBN Co's operations under the National Broadband Companies Act 2011(Cth).

After consultation with the telecommunications industry, the review found a high level of satisfaction among stakeholders with the operation of the legislative framework. The Panel recommended that the broad framework be retained for the time being but made 34 recommendations concerning Part XIC and rules about the operation of NBN Co corporations. The recommended changes were largely concerned with NBN Co's non-discrimination obligations, regulatory recourse to the ACCC in relation to an NBN Co access agreement and oversight of regulatory decision making.
