S-I gets 2-year RI, fine of Rs 5,000 in graft case

Gagan Gupta, a travel agent, alleged that the SHO and SI demanded a bribe of Rs 40,000.

The special CBI court on Monday sentenced Sub-Inspector Hans Raj of the Chandigarh Police, who was convicted under the Prevention of Corruption Act last week, to two years of rigorous imprisonment and a fine of Rs 5,000.

His co-accused Satwant Singh and Jujhar Singh were sentenced to one year’s imprisonment. Also, the former was fined Rs 2,000, and the latter Rs 1,000.

The case arose from the complaint of Gagan Gupta, a travel agent, who alleged that Dilsher Singh Chandel, the then SHO of the Industrial Area police station, and the SI had demanded from him a bribe of Rs 40,000, which was routed through Satwant Singh and Jujhar Singh, who ran a tea stall near the police station. The bribe was for helping Gupta in a case of cheating and impersonation.

In his judgment, special judge Vimal Kumar passed strictures on the CBI, saying that despite the fact that the evidence produced before the court showed thorough involvement of Dilsher Singh Chandel and S-I Hans Raj, the challan did not name Chandel without any “cogent reasons”.

The judgment called it “a glaring fault in the investigation and filing of charge-sheet’’. The CBI had said that they could not find any evidence against the SHO. However, departmental action against Chandel was recommended to the competent authority. The accused were arrested on August 11, 2010. SI Hans Raj was later suspended.
