Bar Council of Kerala on Monday decided to hand over the complaint against advocates
Feni Balakrishnan and Jacob Mathew, to the disciplinary committee for further action, for having behaved in a manner unethical to their profession in the solar case.
The
Bar Council of Kerala was considering a plea seeking disciplinary action against Saritha's former counsel Feni Balakrishnan based on a complaint filed by advocate K Vasudevan of Aluva.
He argued that Feni acted in violation of the rules framed by the Bar Council of India and it can also be considered as a professional misconduct falling under section 35 of the Advocates Act
The Ernakulam economic offences magistrate had asked Feni and the women constable not to disclose the secret statement of Saritha to anyone. He, being the counsel of Saritha and also a member of noble profession is bound to obey the directions of the court, the petitioner argued. However, the next day when media approached advocate Feni, he disclosed the gist of secret statement of Saritha without naming the persons involved.
Advocate Feni had disclosed the confidential statement of Saritha to the media in an interview and later SNDP General Secretary Vellappally Nateshan also quoted him, the complainant said.
