CJM grants bail to driver

SRINAGAR, July 21: Chief Judicial Magistrate Srinagar, VS Bhou, today granted bail to the driver of military crane that had head on collision with a passenger cab this week killing seven commuters.
The accused was driving a military crane that met with an accident on July 16 with a Tavera vehicle at Zainakote HMT Srinagar.  The driver of the vehicle was arrested under FIR No. 139/2014 under Section 279,337 and 304-A RPC and was under police custody in Police Station Parimpora.
“Though the offence alleged to have been committed by the accused is non-bailable in nature but the same is not punishable exclusively with life imprisonment”, observed the court while granting the bail.
The court further added that the accused is presumed to be innocent till guilt is proved against the accused.
Court said that keeping the accused in custody would not serve any useful purpose.
While granting bail to the accused, the court put some conditions on him that he shall be produced before Investigating Officer (IO) as and when required and shall not temper with investigation directly or indirectly.
The court further directed him not to leave the territorial jurisdiction without prior permission of this court. The Army man has been granted bail with a bond of Rs 20, 000.
