Borivali builder, survey officer held for forgery in property grab case

A city survey officer and a builder have been arrested by the Economic Offences Wing of the Mumbai police for allegedly cheating a Borivali-based property owner by forging his property card.

City survey officer Sadanand Kubal, 57, and builder Manjibhai Govindbhai Patel, 78, were in custody of the EOW till July 8, after they were arrested on the basis of a complaint filed by property-owner Deepak Valalbhdas Thakkar, who contended he inherited the plot from his maternal aunt.

Thakkar’s maternal aunt Lakshmibai Thakkar owned a 2,250-sq-ft property at Kasturba Road, Kanheri village, Borivali, which her husband had obtained on sublease in 1943.

The property, named Ram Niwas, previously housed five tenants, but after the death of Lakshmibai in 2003, Deepak evicted them in lieu of money.

The will prepared by the childless Lakshmibai reportedly names Deepak Thakkar as the rightful heir. Thakkar, who runs a bicycle sales business, used the property to house a godown and run a Jain assembly.



In January 2012, a display board outside the property announced that Western Developments, a real estate company, was undertaking an SRA project on the property. Later, the structure on the property was also allegedly demolished by Western Developments.

When Thakkar checked with the city survey office, he found that his maternal aunt’s name had been struck off the property card and the company was listed as its new owner.

The change in the property card was apparently made in 2006.

Armed with his ownership documents, Thakkar approached the city survey office in 2012 and Lakshmibai Thakkar’s name was restored to the property card. The case was subsequently taken to the Economc Offenses Wing.

“On the basis of our investigation, we have registered a case of cheating and forgery against Kanhaiyyalal Shah, Manjibhai Patel, Anjali Kadam, Mukesh Vidyarthi Singh.

“Yateen Kadam, of Western Developments, their architect Sanjay B Shah, and city survey officer Sadanand Kubalhave have also been named,” said an EOW officer.

Additional commissioner of police (EOW) Rajvardhan confirmed the arrest of two suspects in the case. “We will soon arrest the others,” Rajvardhan added.
