Supreme Court to hear Supertech twin tower case today

Supertech, Noida authority and a group of buyers had filed a petition challenging Allahabad high court order to demolish twin towers of Supertech’s Emerald Court in Noida's upscale Sector 93A for flouting building norms.

NOIDA: The Supreme Court will hear Supertech Emerald Court case on Monday. Supertech, Noida authority and a group of buyers had filed a petition challenging Allahabad high court order to demolish twin towers of Supertech’s Emerald Court in Noida's upscale Sector 93A for flouting building norms.
To challenge the same, a group of home-buyers of Supertech's two sealed towers — Apex and Ceyane — had claimed to file a special petition leave (SLP) in the Supreme Court.
The prayer of this group from the apex court is that they should either be allowed to take back their refund or shift to another project.
A separate group had already filed a SLP before the apex court. Prayer of that group is that towers should be regularized, and they should get their flats in the same towers.
In its order on April 11, 2014 the Allahabad high court had ordered the demolition of two 40-storeyed under construction residential towers of Supertech’s Emerald Court for flouting building norms, triggering panic among buyers. The residential towers are part of the realtor's Emerald Court project and the towers have 857 flats, of which 627 are sold out.
Following the petitions, the SC on May 5, had stayed the Allahabad high court order.
The apex court had asked to maintain status-quo on the matter till next hearing July 21.
"Around 10 days back, Emerald Court RWA had filed its reply in the apex court. There are chances that either the developer or the Noida Authority can seek more time to study the RWA reply," said Kumar Ravi Singh, counsel for Supertech Emerald Court RWA.

"Our aim is to take-up our concerns strongly before the apex court. We are the worst hit in the entire episode,” said DK Sharma, a buyer. According to buyers, many other groups are likely to lodge their separate petitions demanding justice in the case.
Supertech Group had earlier mentioned that it has adhered to all laid down norms while constructing the twin towers. The group had also assured buyers to protect their investment.
