‘Jihadi conspiracy’: Hyderabad cleric denied bail

The court said that Qavi is accused of being part of the meeting with one of the key accused in the case — Rasool Party.

A special POTA court on Wednesday rejected the regular bail application of  Hyderabad-based cleric Abdul Qavi in the 2003 “jihadi conspiracy” case. The 58-year-old cleric has been lodged in Sabarmati Central Jail, Ahmedabad, in judicial custody.

The court said that Qavi remained a absconder for the past 11 years. Qav’s lawyer Iliyas Pathan said that court observed that despite court warrants against him, Qavi didn’t surrender before it.

The court also said that Qavi is accused of being part of the meeting with one of the key accused in the case — Rasool Party.

Earlier seeking bail, Qavi’s lawyer had drawn parallels with Askshardham attack case saying that all the accused were acquitted by the Supreme Court on the ground that investigation was not proper.

Qavi’s lawyer had claimed that the “jihadi conspiracy” case was also investigated by the same set of people including IPS officer G L Singhal who is accused in Ishrat Jahan fake encounter case.

Qavi was arrested by Ahmedabad Detection of Crime Branch (DCB) in March from Delhi airport. Last month, DCB officials filed a chargesheet against him stating “As part of the said conspiracy, the accused Maulana Abdul Qavi (Khavi) son of Abdul Gani had attended the meetings with the earlier chargesheeted accused Abdul Samad Md Ibrahim Sunni among others along with Rasool Party…”

The chargesheet mentions that “he joined hands with other accused during April 2002 to April 2003 to take revenge of the loss occurred to the lives and properties to the Muslim community in the large scale communal riots in Gujarat after the Godhra train carnage”.
