SWR told to give 7,000 to man who missed train due to error in nameboard

Anup Nair had seen people missing train due to official goof-ups only in films or TV advertisements till he missed one in August 2013. A resident of Byrasandra, Nair moved Consumer Court, seeking compensation from South Western Railways after he failed to board the Karwar Express on August 31, 2013, as the train bogies did not display correct name boards.

Upholding Nair’s complaint, the 3rd Additional District Consumer Disputes Redressal Commission early this month directed the SW Railways to pay up Rs 7,000 as compensation. In his complaint, Nair stated that he had booked a ticket from Bangalore Central Station to Byndoor/Mookambika Road in Karwar Express on August 31, 2013, paying Rs 945. When he reached the station around 8 pm, he was informed that the train would arrive on platform No 10. The train on the said platform featured the name Kannur Express on bogie nameboards and the display TVs on the platform did not give any information related to the train.

He said that only when the said train moved away from the platform did he notice that the bogies at the end displayed ‘Karwar Express’. He could not board the train as it had already started moving. Nair quickly filed a complaint with station authorities, which refunded him Rs 465 and refused to do anything further. He then moved the Consumer Court seeking compensation.

In their defence, the SW Railway argued, “The facts related to the train were displayed on the electronic display board. Hence, the contention of the complainant that he was misled by the opposite party and because of it, he missed the train, is denied.” (sic)

They have also told that Nair missed the train because he reached the station late. Not agreeing with Railway’s defence, the court on May 8 directed the authorities to pay up Rs 5,000 as compensation for deficiency in service and Rs 2,000 as legal cost. The court also ordered refund of balance ticket fare of Rs 480 within 30 days.
