The Department of Justice has refuted an article published in a local magazine today, alleging it had “let go” defendant Ma Sik-chun.
The department said it had no right to prevent Ma from making the application for discharge of the warrant, and could only deal with it in accordance with the law and evidence.
The department said it informed Ma’s lawyers in 2005 there was insufficient evidence available to the prosecution at that time to justify placing him on trial.
It said it sought legal advice from independent senior counsel in handling the case and the allegation the arrangement involved political considerations was groundless.
