CSC dismisses Binmaley accountant’s appeal

BINMALEY–The Civil  Service Commission (CSC) has dismissed the appeal of Getrudes Reyes, municipal accountant of Binmaley, on her 60-day preventive suspension imposed by Mayor Simplicio Rosario pending  investigation of the complaint against her for alleged dishonesty.

The CSC, in a decision handed down March 19, 2014, signed by Francisco T. Duque III, chairman, and  Commissioners Francisco Martines and Nieves L. Osorio, also affirmed the preventive suspension order.

In dismissing Reyes’ appeal, the CSC said the preventive suspension was made in accordance with the provisions of  Section 26 (A)  and B of the Revised Rules on Administrative Cases in the Civil Service (RRACCS).

“Preventive suspension is designed merely as a measure of precaution so that the official or employee charged may be temporarily removed from the scene of his/her alleged misfeasance/nonfeasance while the same is being investigated”, the decision stated.

The CSC said preventive suspension may be issued to preclude the possibility of exerting undue influence or pressure on the witness against him/her and/or tampering with evidence that may be used against him/her.

Aside from Reyes, also ordered with a 60-day suspension was Jeffrey de los Angeles, budget officer, who was also charged with the same case of dishonesty.

On Aug. 23, 2013, Rosario formally charged Reyes for failure to explain her participation in obligating the municipal government of Binmaley to incur large expenditures that  resulted in a deficit of P3.2 million to the prejudice of the municipal government.

On the same date, Rosario issued a preventive suspension order on Reyes.

Consequently, Reyes filed an appeal before the CSC on Sept. 4, 2013.—LVM
