Dy registrar summons Aamir, complainants

Following a complaint by an octogenarian and her daughter alleging that the managing committee of their housing society on Pali Hill in  Bandra  was misleading home owners and pressuring them to sell 60 per cent of the premises to actor Aamir Khan, who apparently wants the land to build a bungalow for himself, the deputy registrar of cooperative societies has summoned both parties to discuss the matter.

Taking cognizance of a complaint by Dr Pamela de Sa (87), and her daughter Dr Geneve de Sa (50), both residents of Virgo Co-operative Housing Society, the deputy registrar of co-operative societies, S N Patil said Thursday that such a proposal cannot be termed a ‘redevelopment proposal’. “Aamir Khan’s proposal can go through if 100 per cent consent from all members is acquired. In the case of redevelopment, only 75 per cent consent is enough, but in this case, all members should agree to a proposal of selling majority of the premise of the plot.” He added, “Such a situation can also lead to aggrieved parties going to court.”

The family had complained  to the deputy registrar last week that the society’s managing committee has been pushing Khan’s proposal, which they alleged was a “falsely conceived redevelopment scheme”.

“The managing committee is favouring the acceptance of a proposal from Aamir Khan who is trying to purchase 60 per cent of the flats for his own residence by forcibly dis-housing the existing members of the society and compelling them to search for new premises,” the de Sas had written to the deputy registrar on March 11.

The society has 23 members and comprises two ground-plus-three-storey buildings, Marina Apartments and Bella Vista, each of which has 12 flats. Khan owns two flats in Marina and one in Bella Vista, and first expressed interest in acquiring a part of the plot in December 2011.

Kondon Sabloak, member secretary of the society, said it was the society that had approached Aamir Khan to ‘redevelop’ the building. “We fear that no builder will touch this building as the total floor space index (FSI) of the plot is used and builders cannot get any added incentive in redevelopment of this plot. This plot is under Coastal Regulation Zone (CRZ) II and does not have incentive FSI. Aamir Khan’s proposal is the only beneficial proposal we have received so far,” he said.
Sabloak added that Khan had sent his original proposal in December 2011 and it was later revived following requests from the managing committee.

Khan has offered to buy 20,000 sq ft of the 36,207 sq ft (3,364 sq m) property at the rate of Rs 70,000 per sq ft of carpet area from society members interested in selling their flats or garages to him.
On Thursday, a spokesperson for Khan said, “We would like to clarify on behalf of Mr Aamir Khan that he denies all allegations regarding him putting any pressure on his society to go in for redevelopment. The fact of the matter is that Mr Khan left the building more than a year ago, after an incident of a slab of concrete falling on the head of one of the members, resulting in the member being hospitalised”.

“Thereafter, over the months, in his absence, the society had several meetings and discussions, regarding redevelopment. The general body eventually passed a resolution with 80 per cent majority members voting in favour of redevelopment. Thereafter, society made a request in writing to Mr Khan to make an offer. Mr Khan gave the matter due thought and made an offer. In his offer letter, he also suggested to the society to invite other offers to ensure best value for the society and its members. Mr Khan strongly denies any allegations of pressure tactics or misconduct on his part and takes strong exception to attempts being made to defame him,” said the spokesperson.
